1. Validity of the Terms and Conditions
Our offers, deliveries, and services are provided exclusively on the basis of these Terms and Conditions. Deviating terms and conditions of the contractual partner, in particular purchasing conditions, do not apply, even if they are not expressly contradicted. Deviations from our Terms and Conditions are only valid if they have been agreed upon in writing or confirmed by us in writing.
2. Conclusion of Contract
Our offers – including those in catalogs, advertisements, etc. – are subject to change and non-binding. By placing an order, the customer declares their intention to purchase the goods and confirms their status as an entrepreneur. We reserve the right to make changes to shape, color, or size. For assorted items, we only deliver in the specified assortment.
A contract is only concluded upon our written order confirmation or upon delivery. Subsidiary agreements, changes, or additions are only valid with our written confirmation.
3. Prices, Delivery, Shipping Costs, and Payment
Our prices are in euros net, excluding VAT, ex warehouse Saarbrücken. The catalog prices valid on the date of contract conclusion apply.
Deliveries are only made by direct debit, advance payment, or cash on delivery. We grant a 3% discount for advance payment or direct debit, and a 2% discount for cash on delivery. The following terms apply to regular customers who have agreed to pay by invoice: Payment within 8 days of the invoice date with a 2% discount or within 30 days net.
Costs resulting from late payments are borne by the contractual partner. The first two reminders are free of charge; the third is sent by registered mail with return receipt and incurs a processing fee of €15.00.
Returns of defective or defective goods may only be made after prior consultation with us. For cost reasons, we cannot accept returns without postage paid and without comment.
The minimum order value for deliveries within Germany is €150.00. Deliveries abroad (EU and non-EU countries) are only made against advance payment.
Shipping costs within Germany start at €8.90 per package, depending on the weight. For pallet shipments, we charge freight costs according to the freight forwarder's quotation. Shipping costs within EU countries start at €15.90 per package.
4. Delivery Times
Shipment usually takes place within 3 business days of receipt of the order, unless otherwise agreed. Missing items will be delivered later or canceled at the customer's request.
5. Warranty
Minor deviations in the shape, color, or features of samples, models, or digital representations do not constitute a defect. In the case of justified complaints, the customer is entitled to a replacement delivery or a credit note.
Defects must be reported to us in writing within 8 days of delivery. If no notification is received, the delivery is deemed approved.
6. Retention of Title
The delivered goods remain the property of Vina Emporium until full payment has been made.
7. Place of Jurisdiction
The place of jurisdiction is Saarbrücken. The law of the Federal Republic of Germany applies exclusively.
This applies to both these terms and conditions and the entire legal relationship between us and the contractual partner.
